2. Scope and Acceptance

These Terms and Conditions govern the contractual relationship between StayINPorto and any person (hereinafter “Guest”) who makes a booking or uses the accommodations provided. By making a booking, the Guest declares to have read, understood and fully accepted these Terms and Conditions.

3. Available Accommodations

StayINPorto offers three apartments for short and long-term rental in the city of Porto:

  • Apartment in Porto — Fully furnished apartment, centrally located, suitable for both short and long-term stays.
  • Apartment in Lapa — One-bedroom apartment in a quiet residential neighbourhood, well served by public transport and local services.
  • Apartment in Carvalhido — Three-bedroom apartment, ideal for families or groups, with excellent accessibility, including Casa da Música metro station just minutes away.

All apartments are fully furnished and equipped, including fitted kitchens, high-speed Wi-Fi, bed linen and all stay essentials.

4. Bookings

4.1. Bookings can be made directly through the website stayinporto.pt, by email, by phone/WhatsApp, or through third-party booking platforms (such as Airbnb or Booking.com), in which case the terms of those platforms also apply.

4.2. A booking is only considered confirmed upon receipt of written confirmation from StayINPorto and, where applicable, after payment of the deposit or agreed total amount.

4.3. The Guest is responsible for providing accurate and complete information at the time of booking, including the number of guests, check-in and check-out dates, and any special requirements.

5. Pricing and Payment

5.1. Prices are quoted per night or per stay period, as applicable, and include all legally required charges.
5.2. StayINPorto reserves the right to change prices at any time, without prejudice to values already confirmed in existing bookings.
5.3. Payment may be made through the methods provided by StayINPorto or its partner booking platforms. Cash payments above the limits established by Portuguese law are not accepted.
5.4. A refundable security deposit may be required at check-in to cover any potential damages or breaches. The deposit will be returned within 7 days after check-out, provided the accommodation is returned in the same condition in which it was handed over.

6. Check-in and Check-out

6.1. Check-in time is from 3:00 PM and check-out by 11:00 AM, unless otherwise agreed in writing.
6.2. Early check-ins or late check-outs may be subject to additional charges and are always subject to availability and prior confirmation.
6.3. At check-in, the Guest must present valid identification documents (National ID Card or Passport) for all guests, including minors, as required by Portuguese Local Accommodation legislation.

7. Data Retention Period

7.1. Cancellation conditions vary depending on the type of booking and how far in advance the cancellation is made. Specific conditions will be provided at the time of booking.
7.2. For bookings made through third-party platforms (Airbnb, Booking.com, etc.), the cancellation policies of those platforms apply.
7.3. StayINPorto reserves the right to cancel a booking under exceptional circumstances (e.g. force majeure, damage to the property), in which case a full refund of amounts paid by the Guest will be issued.

8. House Rules

The Guest agrees to:
8.1. Use the accommodation exclusively for residential purposes. Subletting or transferring the use of the accommodation to third parties without express written authorisation is not permitted.
8.2. Respect condominium rules and good neighbourly conduct, particularly regarding noise, especially between 11:00 PM and 8:00 AM.
8.3. Not smoke inside the accommodation. Smoking is only permitted in designated outdoor areas, where available.
8.4. Not hold parties, events or unauthorised gatherings in the accommodation.
8.5. Not bring pets into the accommodation without prior express authorisation from StayINPorto.
8.6. Treat the accommodation, furniture and equipment with care, being responsible for any damage caused during the stay beyond normal wear and tear.
8.7. Not permanently rearrange furniture or equipment.
8.8. Immediately report any malfunction, damage or issue identified in the accommodation.

9. Liability

9.1. StayINPorto undertakes to provide the accommodation in the described condition and to offer support to the Guest throughout the stay.
9.2. StayINPorto is not liable for the loss, theft or damage of the Guest’s personal belongings during the stay.
9.3. The Guest is responsible for their own actions and those of all accompanying guests during the stay.
9.4. In the event of damage caused by the Guest, StayINPorto reserves the right to retain all or part of the security deposit and/or claim compensation for the value of the damages.

10. Maximum Number of Guests

The maximum number of guests per accommodation is as stated in each apartment’s description. Unregistered guests are not permitted to stay on the premises. Failure to comply with this rule may result in the immediate termination of the booking without any right to a refund.

11. Reporting to Authorities

Under applicable Portuguese legislation governing Local Accommodation (Decree-Law No. 128/2014 and subsequent amendments), StayINPorto is legally required to report the identification details of all guests to the competent authorities (SEF/AIMA, PSP/GNR) through the SIBA/RNAL system. By making a booking, the Guest consents to this legal obligation.

12. Data Protection

The processing of personal data is carried out in accordance with StayINPorto’s Privacy Policy, available at stayinporto.pt/privacy-policy/, and in compliance with the General Data Protection Regulation (GDPR).

13. Intellectual Property

All content on the website stayinporto.pt, including texts, images, logos and design, is the property of StayINPorto and is protected by copyright. Reproduction, distribution or use without express authorisation is prohibited.

14. Changes to the Terms and Conditions

StayINPorto reserves the right to update these Terms and Conditions at any time. Changes will be published on this page with the date of update indicated. Guests are encouraged to review this document regularly before each booking.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by Portuguese law. In the event of a dispute, the Courts of the Comarca of Porto shall have jurisdiction, without prejudice to the Guest’s right to resort to alternative dispute resolution (ADR) mechanisms or the European Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr).
